Welcome to WIZREAL. We’re on a mission to make real estate easier, smarter, and more transparent. WIZREAL offers a platform for users to search property listings, compare prices, access neighbourhood data, and connect with trusted real estate professionals across Canada. Whether you're browsing for your next home, researching market trends, or looking to list a property, WIZREAL empowers you with the insights and tools to make confident decisions.

1. Eligibility and Account Registration

You must be the age of majority in your jurisdiction to use the Services. By registering an account or accessing the Services, you represent and warrant that you meet this requirement and that the information you provide is accurate and complete.

If you are using the Services on behalf of an organization, you must have the authority to bind that organization to these Terms.

2. Description of Services

WIZREAL provides a digital platform that enables users to:

• Search and browse real estate listings by filters such as location, price, and property type
• Access neighbourhood insights, price trends, and home valuation tools
• Save properties, set alerts, and manage search preferences
• Connect with third-party real estate professionals upon request
• Share listings and use messaging or inquiry features (where available)

WIZREAL is not a licensed brokerage and does not represent users in any real estate transaction. Listings are sourced from multiple real estate boards and associations across Canada, including but not limited to the Toronto Regional Real Estate Board (TRREB), Real Estate Board of Greater Vancouver (REBGV), Fraser Valley Real Estate Board (FVREB), Calgary Real Estate Board (CREB), and other participating real estate organizations. All listing data is protected by copyright owned by the respective boards. The information provided is intended for personal, non-commercial use by consumers and should not be used for any other purpose. Users are advised to independently verify all property details. WIZREAL does not guarantee the accuracy, currency, or completeness of any listing data, and assumes no responsibility for errors or omissions.

3. Use of Services

You agree to use the Services for lawful purposes only and in compliance with all applicable laws. This includes compliance with our Acceptable Use Policy, which applies to all users, including buyers, sellers, agents, brokerages, and any individuals or organizations accessing the platform. You may not:

• Harass, impersonate, or defraud others
• Infringe on intellectual property or other proprietary rights
• Upload viruses, malware, or malicious code
• Attempt to reverse-engineer or interfere with the Site's functionality
• Collect or harvest data from the Site through automated means
• Submit false or misleading content, including fake listings or reviews

WIZREAL’s Acceptable Use Policy includes specific guidelines on content standards, prohibited conduct, and security measures, and is incorporated by reference into these Terms. Violation of the Acceptable Use Policy may result in suspension or termination of your access to the Services.

Real estate professionals are responsible for ensuring their listings are truthful, current, and comply with all applicable real estate advertising and licensing laws.

4. Communications and Notifications

By providing your contact information, you agree to receive communications from WIZREAL, including service updates and promotional content. You may opt out of promotional emails at any time.

5. User Content and Feedback

You retain ownership of any content you submit through the Services but grant WIZREAL a worldwide, non-exclusive, royalty-free license to use, reproduce, and distribute such content to operate and promote the Services.

Feedback you provide may be used without obligation to you.

6. Third-Party Services

The Services may include links to third-party websites or integrations. WIZREAL is not responsible for the content or practices of those third parties. Your use of third-party sites is at your own risk and subject to their respective terms and privacy policies.

Use of certain features, including map views, may be subject to additional terms from Google, OpenStreetMap, and other integrated services. By using these features, you agree to comply with any applicable third-party terms.

7. Disclaimers and Limitation of Liability

The Services are provided "as is" and "as available" without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. While we strive to provide accurate and reliable information, we do not guarantee the completeness, timeliness, or accuracy of any content made available through the Services.

To the fullest extent permitted by law, WIZREAL shall not be liable for any damages of any kind arising from the use of or inability to use the Services, including but not limited to direct, indirect, incidental, special, punitive, or consequential damages; damages for loss of profits, revenue, data, or use; or damages for personal or property harm resulting from use of the Services.

Examples of excluded claims include:

• Inability to access listings due to downtime
• Delays in service notifications or messages
• Errors in real estate information sourced from third-party boards
• User decisions based on market estimates, listings, or agent connections

WIZREAL’s total liability in connection with the Services shall not exceed the greater of: (a) CAD $100; or (b) the amount you paid to WIZREAL in the twelve (12) months preceding the event giving rise to the claim.

Some jurisdictions may not allow exclusions or limitations of certain damages, so some of the above limitations may not apply to you.

8. Modifications to the Terms

We may update these Terms from time to time. Changes will be posted on the Site, and your continued use of the Services constitutes acceptance.

9. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes shall be resolved in the courts of Ontario.

10. Termination of Access

We reserve the right to suspend or terminate your access to the Services at our sole discretion, without notice, for conduct that we believe violates these Terms or is otherwise harmful to other users, WIZREAL, or third parties. Upon termination, your right to use the Services will immediately cease, and you must promptly delete any downloaded or stored content obtained through the Services.

11. User Representations and Warranties

You represent and warrant that:

• All information you provide is truthful and accurate;
• You have the legal capacity to agree to these Terms;
• You will comply with all applicable laws and regulations;
• You will not use the Services for any unlawful or unauthorized purpose.

12. Indemnification

You agree to indemnify, defend, and hold harmless WIZREAL and its affiliates, directors, officers, employees, and agents from and against all claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from or related to: (a) your use of the Services; (b) your breach of these Terms; or (c) your violation of any third-party rights.

13. Force Majeure

WIZREAL shall not be liable for any delay or failure in performance resulting from causes beyond its reasonable control, including acts of God, natural disasters, pandemics, power failures, internet outages, government actions, or labor disputes.

14. Intellectual Property

All content, design elements, logos, trademarks, software, and materials made available through the Services are the intellectual property of WIZREAL or its licensors. You may not copy, reproduce, distribute, or create derivative works without our prior written consent. Unauthorized use may result in civil and/or criminal liability.

Subject to these Terms, WIZREAL grants users a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial purposes.

15. Entire Agreement and Severability

hese Terms, including our Privacy Policy and Acceptable Use Policy, and any linked or referenced documents, constitute the entire agreement between you and WIZREAL. If any provision is found to be unenforceable, the remaining provisions shall remain in full force and effect.

16. Language

These Terms are drafted in English. Any translated version is provided for convenience only. In the event of a conflict between the English version and a translation, the English version shall prevail.

17. Board Attribution and Copyright Notices

All listing data is subject to the terms and conditions of the respective real estate boards. Copyright and all intellectual property rights remain with the original data providers. Users may not scrape, aggregate, or republish listing data without express written permission from the originating board.

18. Privacy Policy

WIZREAL is committed to protecting your privacy and personal information. For details about how we collect, use, store, and protect your data, including your rights and choices under applicable laws, please refer to our full Privacy Policy, which is incorporated by reference into these Terms.

19. Virtual Office Website (VOW) Requirements

WIZREAL is a member of real estate associations, boards, and similar organizations across Canada (collectively and individually, the "Real Estate Boards"), and provides you with access to information from these entities through a Virtual Office Website ("VOW"), pursuant to the following terms.

General Requirements

You acknowledge and agree that:

• You are entering into a lawful broker-consumer relationship with WIZREAL.
• All information obtained by you from WIZREAL is intended only for your personal, non-commercial use.
• You have a bona fide interest in the purchase, sale, or lease of real estate of the type being offered through WIZREAL.
• These Terms of Use do not create a fiduciary obligation or agency relationship between you and WIZREAL.
• The information contained on WIZREAL is based in whole or in part on information that is provided by other members of the Real Estate Boards who are responsible for its accuracy. The Real Estate Boards reproduce and distribute this information as a service for their members and assume no responsibility for its accuracy.
• You will not copy, redistribute, retransmit, or otherwise use any of the data provided, except in connection with your consideration of the purchase or sale of an individual property.
• You will not, directly or indirectly, display, post, disseminate, distribute, publish, broadcast, transfer, sell or sublicense any data obtained through the VOW to another individual or entity. The prohibited uses expressly include "scraping" (including "screen scraping" and "database scraping"), "data mining" or any other activity intended to collect, store, re-organize, summarize or manipulate the data.
• You expressly authorize the Real Estate Boards or their duly authorized representatives to access your information provided to WIZREAL for the purposes of verifying compliance with and pursuing enforcement of these Terms of Use and all applicable rules, regulations, bylaws, policies, and laws.

Specific Real Estate Board Requirements

To the extent applicable, you acknowledge:

• The Canadian Real Estate Association (CREA) is the owner of the REALTOR® and MLS® trademarks: REALTOR®, REALTORS®, and the REALTOR® logo are certification marks that are owned by REALTOR® Canada Inc. and licensed exclusively to CREA. These certification marks identify real estate professionals who are members of CREA and who must abide by CREA's By-Laws, Rules, and the REALTOR® Code. The MLS® trademark and the MLS® logo are owned by CREA and identify the quality of services provided by real estate professionals who are members of CREA.
• The Toronto Regional Real Estate Board (TRREB) owns and retains the validity of its proprietary rights and copyright in the MLS® database, TRREB's MLS® System, TRREB's listing information and any related data.
• The Information Technology Systems Ontario (ITSO) owns and retains the validity of ITSO's copyrights in the MLS® System data.
