Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the WIZREAL application (the "Service") operated by WIZREAL ("us", "we", or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service. By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

1. Description of Service

Wizreal is a real estate application designed to provide users with property listings, market information, and related services. The Service aggregates and displays real estate data from various sources to assist users in their property search and decision-making process.

While we strive to provide accurate and up-to-date information, WIZREAL does not guarantee the accuracy, completeness, or timeliness of the data provided through these feeds. All information is provided "as is" without warranty of any kind. Users are encouraged to independently verify any information before relying on it. The data is for personal, non-commercial use only.

You acknowledge that the MLS® mark and associated logos are owned by CREA and identify real estate professionals who are members of CREA. The VOW® data feed is operated by various real estate boards and associations.

The data relating to real estate for sale on this website comes in part from the Broker Reciprocity Program (VOW® Feed) of the Canadian Real Estate Association (CREA) and the Toronto Regional Real Estate Board (TRREB). Real estate listings held by brokerage firms other than [Your Brokerage Name, if applicable] are marked with the appropriate VOW® logo or detailed information about them includes the name of the listing brokers. You are responsible for safeguarding your account information, including your password, and for any activities or actions under your account. You agree to notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

4. Location-Based Services

WIZREAL may offer features that utilize your device's location. If you choose to use these features, you consent to WIZREAL collecting, using, and disclosing your location data to provide and improve these services. You can enable or disable location services when you use the Service at any time, through your device settings. We will not share your precise location with third parties without your explicit consent, except as required by law or as necessary to provide the Service.

The Service and its original content (excluding content provided by users or third-party data feeds), features, and functionality are and will remain the exclusive property of WIZREAL and its licensors. The Service is protected by copyright, trademark, and other laws of both Canada and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Wizreal.

The trademarks REALTOR®, REALTORS®, and the REALTOR® logo are controlled by CREA and identify real estate professionals who are members of CREA. The trademarks MLS®, Multiple Listing Service® and the associated logos are owned by CREA and identify the quality of services provided by real estate professionals who are members of CREA. These trademarks are used under license.

Our Service may contain links to third-party web sites or services that are not owned or controlled by Wizreal.

Wizreal has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party web sites or services. You further acknowledge and agree that WIZREAL shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

We strongly advise you to read the terms and conditions and privacy policies of any third-party web sites or services that you visit.

8. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

If you wish to terminate your account, you may simply discontinue using the Service. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. USE OF THE SERVICE IS AT YOUR SOLE RISK. TO THE FULL EXTENT PERMISSIBLE BY APPLICABLE LAW, WIZREAL DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WIZREAL DOES NOT WARRANT THAT THE SERVICE, ITS SERVERS, OR E-MAIL SENT FROM WIZREAL ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WIZREAL WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM THE USE OF THIS SERVICE, INCLUDING, BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, AND CONSEQUENTIAL DAMAGES.

SPECIFICALLY, INFORMATION PROVIDED THROUGH THE DATA FEEDS (ITSO, CREA, TRREB, REALTOR.CA, ETC.) IS SUBJECT TO THE DISCLAIMERS AND LIMITATIONS OF THOSE PROVIDERS, AND WE PASS THOSE ON TO YOU. WE DO NOT VERIFY OR GUARANTEE THE ACCURACY OF THIS THIRD-PARTY DATA.

10. Limitation of Liability

IN NO EVENT SHALL Wizreal, NOR ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (III) ANY CONTENT OBTAINED FROM THE SERVICE (INCLUDING DATA FROM ITSO, CREA, TRREB, REALTOR.CA); AND (IV) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

11. Indemnification

You agree to defend, indemnify and hold harmless WIZREAL and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password; b) a breach of these Terms, or c) Content posted on the Service.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have had between us regarding the Service.

13. Changes to Terms of Service

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
